Terms of Use

These Terms of Use set out the rules applicable to the use of the Ma Belle Note service by the Customer and its Users.

01Acceptance of the Terms of Use

Access to the Service entails the unreserved acceptance of these Terms of Use by the Customer and by each User acting on its behalf. Capitalised terms not defined here have the meaning given to them in the SBCQ SAS Terms of Sale.

If a User does not accept these Terms of Use, they must refrain from using the Service. Continued use of the Service after notice of any change constitutes acceptance of the new terms.

02Sign-up and Account

Using the Service requires the creation of an Account by an adult, acting on behalf of a professional holding an active Subscription. The Customer is responsible for the accuracy of the information provided at sign-up and for keeping it up to date.

Each User is issued personal credentials (email and password, or authentication via a trusted identity provider). Users must keep those credentials confidential and must not share them. Every action performed from an Account is deemed to have been performed by the User holding that Account.

In case of loss, theft or suspected compromise of credentials, the User must notify the Publisher without delay at [email protected].

03Proper use of the Service

The Customer and its Users undertake to use the Service in accordance with its intended purpose, applicable law (notably the GDPR, French consumer law, commercial law and the LCEN) and the terms of any connected third-party platform (notably Google Business Profile).

The following are in particular prohibited:

  • using the Service to publish fake reviews, undisclosed paid reviews, or any review that does not reflect a real customer experience;
  • publishing defamatory, insulting, hateful, discriminatory, violence-inciting or dignity-violating content;
  • attempting to circumvent quotas, technical limits or security measures of the Service;
  • mass data extraction (scraping), reverse engineering of the Service, or using the Service to train competing artificial intelligence systems;
  • impersonating a third party, a customer or another professional;
  • automating replies to sensitive situations (dispute, accusation, threat) without prior human review.

04Content published through the Service

The Service allows the Customer to publish replies to reviews, social media visuals and associated copy (the "Content"). The Customer retains ownership of its Content and bears full editorial responsibility for it, including when the Content is generated with the help of AI modules.

The Customer warrants that it holds all rights necessary over the Content it publishes and undertakes to review every AI-generated suggestion before publication, in particular when the source review relates to a sensitive topic (health, accusation, dispute, identifiable third-party data).

The Publisher does not exercise prior editorial control over the Content, but reserves the right to refuse automatic publication or to suspend an Account on the basis of a substantiated report or an observation of manifestly abusive use of the Service.

05Customer reviews and third-party platforms

The Service aggregates and processes reviews published by third parties on partner platforms. Those reviews remain governed by the terms of the source platform. The Customer acknowledges that the Publisher has no control over moderation, retention or deletion of reviews on those third-party platforms.

Connecting a third-party account to the Service requires the Customer's explicit authorisation and relies on the official OAuth flows and APIs made available by the platforms. The Customer may revoke that authorisation at any time from its Account or from the relevant third-party account.

06Artificial intelligence — transparency and safeguards

Certain features (draft replies, monthly summaries, action suggestions, visual generator) rely on AI models provided by third parties (Anthropic, OpenAI or any subsequent provider). These models may produce factual errors, inappropriate phrasing or unintentionally biased content.

The Publisher implements safeguards aimed at detecting sensitive cases (insults, threats, accusations, legal disputes) and blocking automatic publication of replies in those situations. These safeguards rely on heuristics and are not exhaustive: the Customer remains responsible for human review of the Content.

Prompts and Content processed by the AI models are forwarded to the third-party providers under the conditions described in the Privacy Policy and the DPA. The Publisher enables by default the opt-out for training reuse, when the provider offers such an option.

07Availability and updates

The Service is accessible 24/7, subject to planned maintenance windows and cases of force majeure. The Publisher uses its best endeavours to meet the availability target defined in the Terms of Sale.

The Publisher may update the Service at any time (fixes, improvements, new features, removal of seldom-used features). Material changes are notified in the Service and/or by email.

08Suspension and termination of the Account

The Publisher may suspend access to the Account in the event of manifest violation of the Terms of Use, suspected fraudulent use, non-payment or security risk (credential leak, abnormal activity). The suspension is notified by email, with the reason and the actions expected for regularisation.

After suspension, the Publisher may restore access to the Account once the issue is resolved, or terminate the Subscription under the Terms of Sale in the event of serious or repeated breach.

09Intellectual property

The Service, all its components (interface, code, text, illustrations, databases) and related distinctive signs are the exclusive property of SBCQ SAS or its licensors. These Terms of Use grant no intellectual property right over the Service, but only a personal, non-exclusive, non-transferable right of use limited to the duration of the Subscription.

10User liability

Each User is personally responsible for their actions on the Service. The Customer, as Subscription holder, is jointly and severally liable for the actions of its Users vis-à-vis the Publisher.

11Changes to the Terms of Use

The Publisher may amend the Terms of Use to reflect changes in the Service, the regulation, or operational risks. Amendments are published in the Service and notified by email 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the new Terms of Use.
